Terms of Service
These terms apply when you use the DataDad website, dashboard, tracking script, app SDK, uptime monitoring and alerts. By creating an account or using the service, you agree to them.
Updated
Who we are
DataDad (data.dad) is operated by:
Petr PellerSole trader (OSVČ), Czech Republicsupport@data.dadIn these terms, “we” and “us” mean the operator. “You” means the person or organization that uses DataDad or holds a DataDad account.
The service
DataDad provides:
- Web and app analytics: a tracking script and an app SDK send events to DataDad, and the dashboard shows reports on traffic, goals, revenue and funnels.
- Uptime monitoring: checks of your websites and endpoints, incidents, status pages, badges, and alerts by e-mail and text message.
- Keyword tools: App Store search rankings and keyword data for your apps.
- Free tools on the website, such as calculators and a down checker.
We can change, add or remove features. Some features are in beta, and access to them can depend on an invitation.
Accounts
Use a valid e-mail address that you control, and keep your password and passkeys safe. You are responsible for what happens in your account. Tell us at support@data.dad if you think someone else has access to it.
You can stop using DataDad at any time. To close your account, write to support@data.dad from your account e-mail address. We can suspend or close an account that breaks these terms. Where possible, we tell you first and give you time to fix the problem.
Acceptable use
You agree not to:
- Monitor websites, servers or endpoints that you do not own or are not allowed to check.
- Use checks to load-test, attack or overload a system, or try to get around check intervals, alert limits, code limits or other limits.
- Add e-mail addresses or mobile numbers of people who have not agreed to receive alerts.
- Abuse alerts or one-time codes, for example to send messages to numbers that are not yours.
- Send data to DataDad that you are not allowed to collect, or special categories of personal data such as health data, or payment card data.
- Interfere with the service, other accounts or their data, or access the service other than through the interfaces we provide.
- Use DataDad for anything unlawful.
If you collect analytics data about the visitors and users of your websites and apps, you are responsible for telling them and for any consent that the law requires.
Free monitors
Uptime monitors are free within the limits shown in the dashboard, such as the number of monitors and the check intervals. E-mail alerts are free. We can change these limits. If a change affects monitors that you already run, we tell you by e-mail before it takes effect.
Prepaid text message credit
- Text message alerts are paid from a prepaid balance in euros. You buy credit in the dashboard on the Credits page. Stripe processes the payment, and we never see your card number.
- Each text message, including a one-time code, uses credit at the price for its destination country that the Credits page shows when the message is sent. Prices can change. A new price applies only to messages sent after the change.
- When a message cannot be sent or is reported as not delivered, we return its price to your balance.
- If your balance is too low, we do not send text messages. E-mail alerts continue.
- Credit does not expire while your account exists. Credit has no cash value and you cannot transfer it to another account.
- We refund purchased credit only where the law requires it.
SMS Terms
Program name: DataDad Uptime Alerts.
Messages we send
An alert when one of your uptime monitors goes down, an alert when it comes back up (you can turn this off for each number), and one-time codes that confirm your mobile number. We do not send marketing messages.
How you opt in
- Sign in to the DataDad dashboard and open Uptime → Alerts. Choose Text message, or open “Add a mobile number”.
- Enter your mobile number and read the program details on the form.
- Check the box “I agree to receive DataDad Uptime Alerts by text message at this number.” The box is not checked for you.
- Select “Yes, send me text alerts”. We text a one-time code to the number. Alerts start only after you enter the code in the dashboard.
You can see the form on the Text message alerts page.
Message frequency
Message frequency varies with your monitors’ status. We send at most 20 alert messages per hour to one number, and at most 3 one-time codes per hour to one number.
Costs
Message and data rates may apply. Each text also uses credit from your DataDad balance, as described in Prepaid text message credit.
Help and opting out
Reply HELP for help. Reply STOP to cancel; we confirm with one final message and send no more. Words such as UNSUBSCRIBE, CANCEL, END and QUIT also cancel.
You can also pause or remove a number at any time on the Alerts page in the dashboard, or ask us at support@data.dad. In countries where our messages come from the sender name “DataDad”, phones cannot reply to them, so use the dashboard or e-mail instead.
Opting in again
After a STOP reply, reply START to our number, then select Resume next to the number on the Alerts page. You can also remove the number and add it again with the consent box.
Supported countries
Austria, Australia, Brazil, Czechia, France, Germany, India, Italy, the Netherlands, Poland, Slovakia, Spain and the United Kingdom. The United States and Canada are added only after carriers approve our toll-free number.
Delivery
Carriers are not liable for delayed or undelivered messages.
Support and privacy
Write to support@data.dad. The Privacy Policy explains how we use your mobile number. We do not sell, rent or share mobile numbers or opt-in data with third parties for marketing.
Availability
We provide DataDad “as is” and “as available”. We work to keep it running, but we do not promise that it is always available, that every check runs on time, or that every alert arrives. E-mail and text message delivery also depend on networks and providers that we do not control. We can carry out maintenance, which can interrupt the service for a short time.
Liability
To the extent the law allows, we are not liable for indirect or consequential loss, or for lost profits, revenue, business or data. To the extent the law allows, our total liability for all claims is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability that the law does not allow us to limit, or your rights as a consumer under mandatory law.
Changes to these terms
We can update these terms. We publish the new version on this page with a new date. If a change is important, we tell account holders by e-mail before it takes effect. If you continue to use DataDad after a change takes effect, the new terms apply.
Governing law
Czech law governs these terms, and the courts of the Czech Republic decide disputes. If you are a consumer, you keep the protection of the mandatory law of the country where you live. Consumers can also use out-of-court dispute resolution at the Czech Trade Inspection Authority (Česká obchodní inspekce).
